TERMITES ATE MY JUSTICE: HOW KERALA COURTS OUTSOURCED TRUTH TO INSECTS

In the annals of India’s judiciary, few cases spotlight systemic decay like the Kafkaesque ordeal unfolding in Kerala’s courts. In a chilling blend of judicial neglect and bureaucratic cover-up, courts — including the Hon’ble High Court of Kerala — repeatedly upheld a fraudulent police report filed by a Sub Inspector notorious for corruption, while turning a blind eye to legitimate documentary evidence and foreign rulings in favor of the complainant.

Judicial misconduct must not hide behind robes: A Call to Conscience Against the Recycling of Police Falsehoods
by the Judiciary "Legal Judgments at Twitter, now X"

The complainant, an NRI businessman, armed with international judgments and original business documents, sought relief in 2009, demanding that the case be transferred to the Central Bureau of Investigation. What followed was a tragicomic theatre of judicial irresponsibility. The Sub Inspector filed a baseless report — unaccompanied by a single shred of proof — and even claimed a false conviction abroad.

Courts did not question the lack of documentation. Instead, they echoed the SI’s fiction, ignoring RTI pleas and, when pressed, excused the missing documents as "eaten by termites." This farcical excuse was accepted without resistance.

In 2012, a flicker of justice returned when a magistrate initiated criminal proceedings under IPC Sections 403, 406, and 420. But once again, the system twisted back upon itself. The accused vanished, only to re-emerge with a High Court order quashing the proceedings. A subsequent judge then reaffirmed the very police report that had earlier been discredited.

The final blow came when a magistrate declared the complainant dishonest — contradicting previous judicial findings — and dismissed the matter entirely. The result: a judicial system that validates lies, suppresses evidence, and blames ants for institutional failure.

This case demands a systemic review. For a justice system that cites termites in lieu of truth has ceased to serve the people. ..."FULL TEXT: HOW A NEGLECTED FILE SYMBOLIZED A BROADER DECAY IN COURTS"

Need for establishing a viable Indo-Gulf Reparation Mechanism

“The establishments of institutional arrangements for the welfare of ‘Overseas Indian Community’, as highlighted by the Government of India, are intentionally deceptive, untruthful, and purport to demonstrate that there are procedural remedies or tactics. Serious failures and inadequacies to comply with statutory or regulatory obligations on the part of both the Ministries, the Ministry of External Affairs (MEA) & the ‘Ministry of Overseas Indian Affairs’ (MOIA) now stands proved by the subsequent communications received by petitioner, from the Ministry of External Affairs, Government of India”.Indo-Gulf Reparation Mechanism

The Concept of Reparations:
Reparation for the victims or survivors of torture, which is their right under international and many national laws, is becoming more and more a realistic possibility. As a result, many legal academics and lawyers, sociologists, medical practitioners and psychologists are now discussing the concept of reparation. ...The Concept of Reparations

What role for India in the protection of their citizens abroad?
The US is very much concerned about the safety of their citizens who travel around the world throughout the year for business, vacation, employment etc., and are detained on charges of various types. Immediately on receipt of notification of such cases, Consular support is made available to them.

The Vienna Convention is the base for such activities. Government of India could also render similar Consular assistance to protect its helpless citizens who suffer in the prisons and custody of Police in foreign countries and the GCC (Gulf) countries in particular. Some of the salient points of the statement of Patrick F. Kennedy are quoted here for consideration and implementation by the Government of India to protect the lives of Overseas Indians.
